Churchill Email Policy
It’s important to Churchill Mortgage to provide various means of
communicating with our customers this includes but isn’t limited to Email,
text message, telephone, voicemail, online chat, instant message, blog
comments, social media, fax machine, and regular mail. Because of this, we
also think it’s equally important to provide you with terms and conditions
for these methods of communication.
Email you receive from Churchill Mortgage is conditioned upon your
agreement to the following terms:
Email is a way that we communicate to you but at times it can be brief and
informal. Due to this, Emails may not accurately represent the entire
matter in relation to getting a mortgage, or the mortgage process. In many
instances, communications about a particular situation or loan example are
exchanged through various channels like Email, telephone calls, voicemails,
texts, faxes, letters, postcards, instant messages, social media responses
and engagement, and in person. Sometimes multiple forms of communication
may be exchanged through multiple channels at the same time. Accordingly,
an Email, by itself, may not accurately reflect the complete communication
or intent of Churchill Mortgage as it can be taken out of context. All
official home loan matters should be subsequently confirmed in signed
writings and documents. Also, the receipt of an Email from Churchill
Mortgage may not put us on notice of any matters/issues contained within
that particular, Email.
Unless there is explicit and specific language and disclosures to the
contrary, Emails from Churchill Mortgage do not contain or constitute
an electronic signature, even if the sender's name appears in the Email.
Email communications are not intended to be construed against the Company
as an interest rate lock, an unconditional loan commitment, an
unconditional loan approval, unconditional qualification, or any
unconditional offer or agreement to lend. Such documents and agreements are
generally sent to clients in formal signed writings from the Company.
Emails (and all attachments) sent by Churchill Mortgage team members and
representatives are confidential and should be reviewed to only the
individual to whom they are addressed and intended. Any unauthorized use,
disclosure, reproduction, or distribution is prohibited. If you received an
Email in error or if it was improperly forwarded to you, the information
contained in the Email should remain confidential and does not authorize
you to use or share any confidential information. Notify the sender
immediately by telephone or Email and delete the original. Treat these
Emails marked as "confidential" and stay in compliance with privacy laws
(including but not limited to the Gramm-Leach-Bliley Act). Ensure
confidential information is not disclosed or used by others. By accepting
the confidential information provided by Churchill Mortgage, you agree to
hold Churchill Mortgage harmless against any and all claims, losses,
liabilities, or expenses that Churchill could incur as a result of the
unauthorized use or disclosure of confidential information due to your acts
Emails exchanged with or involving our legal and compliance teams may
contain privileged information subject to the attorney/client privilege
and/or the attorney/work product privilege. Such privileged information
will not be waived if you receive an Email in error or if it was improperly
forwarded to you. If you are not the intended recipient of privileged
information, please notify the sender immediately by telephone or Email,
and delete or destroy the original and any copies. Unauthorized use,
disclosure, reproduction, or distribution of confidential or privileged
information is prohibited.
Filters and Time Sensitive Instructions
Please do not use Email to communicate time-sensitive instructions or
official company matters; they may not be received or reviewed by the
appropriate Churchill team member or representative in a timely manner. All
Emails are processed through both virus and spam filters which may
delay/reject the delivery of an Email or Emails. Urgent matters should
always be communicated directly with the person of concern by telephone,
and also confirmed in writing with the appropriate person by fax or Email.
Churchill Mortgage reserves the right to block any Email source it sees as
Emails from Churchill Mortgage are to be used only for conducting mortgage
business with our company. Vendors, suppliers, clients, and others receiving
Email from team members at Churchill Mortgage may not use any Email address
or team member’s contact information (or any other person's Email address
appearing on or in a Churchill Mortgage Email) for any purpose other than
corresponding with Churchill for lawful and legitimate business
purposes relating to the business of our company. The receipt of an Email
is not Churchill’s consent, nor an individual Churchill team member's
consent, for you to use our Churchill Email addresses or contact
information for direct marketing purposes or for transfers of data to
third-parties, and such use is prohibited.
All Emails sent to or from Churchill’s team members may be forwarded,
monitored, and/or reviewed by others within our company other than the
designated recipient/sender with or without notice to the designated
recipient/sender. We may also record or monitor other forms of
communications you have with us via the website, instant message, social
media, chat, Email, and telephone. By using these communication methods you
are consenting to the recording or monitoring of the same.
Unsecure Email Transmissions
Regular Email is typically sent via the Internet which is an open network.
While certain designated areas within our website and webpages employ
technologies to secure your data and the transmissions between you and
Churchill Mortgage, general Email uses the Internet which is an open system
and we cannot provide absolute assurances that all Email transmissions
(sent or received) are secure, incomplete or virus free and/or that they
won't be lost, misdelivered, destroyed, delayed, or intercepted/decrypted
by others. Churchill advises against Emailing time-sensitive or personal
identifiable information over Email and disclaims all liability with regard
to Emails (in addition to the content within the Email) if they are lost,
destroyed, delayed, incomplete, misdelivered, intercepted/decrypted or

defects that could cause harm to your computer system, please note that
computer viruses can still be transmitted through attachments, content, and
links. It is the recipient’s responsibility to make sure that any Email
opened on their computer system is free of any harmful viruses. Churchill
Mortgage is not liable for loss or damage due to the use, transmission, or
storage of our Emails. If any team member at Churchill replies or an Email,
the contents may have been produced by someone other than a Churchill
Mortgage representative and we assume no liability. Churchill Mortgage
revokes any warranty or representation that Emails from our company are
free of viruses and/or are error free. The use of Email to cause harm by
way of a virus, disabling code, or otherwise that interferes with Churchill
Mortgage Email transmissions, phone system, or computer networks is
prohibited and against the law; all violators will be prosecuted.
Churchill Mortgage team members and representatives are strictly prohibited
from using Email to send defamatory, discriminatory, harassing, or
offensive statements/materials/graphics, or anything that infringes the
copyrights or legal rights of others via Email. These communications are
against Churchill Mortgage policy and outside the scope of the Churchill
Mortgage employment of individual team members and representatives. We do
not accept any liability in respect of these communications, and the
individual team member or representative will be responsible and personally
liable for any damages or other liability arising. Report violations to our

Churchill Mortgage’s Email systems for purposes of sending defamatory,
discriminatory, harassing, or offensive statements/materials/graphics to any Churchill team members or
representatives is prohibited and unlawful; violators will be prosecuted.
Use of Churchill’s Email systems for purposes of soliciting our Churchill
team members and representatives to breach their employment agreements or
to interfere with their employment status with Churchill Mortgage is also

Churchill Mortgage reserves all rights to our content in our Emails in
addition to this Email policy. No part of Churchill Mortgage’s Emails or
email policy can be used without the written permission of a representative of
Churchill Mortgage’s Chief Compliance Officer.
Churchill Mortgage disclaims any U.S. federal tax advice contained in or
provided through Email (including any attachments). Any reliance upon such
tax advice cannot be used, for the purpose of (i) avoiding penalties under
the Internal Revenue Code or (ii) promoting, marketing or recommending to
any other party.
Churchill Mortgage disclaims all responsibility, including but not limited
to negligence or negligent misstatements for accuracy and reliability of
data contained in or provided through Email. Churchill makes no warranties,
with respect to such data.
In receiving and opening Emails from Churchill Mortgage, you agree to the
terms and conditions provided to you by Churchill Mortgage. Any disputes
pertaining to Churchill Mortgage Emails will be governed by and in
accordance with the laws of the State of Tennessee, without giving effect
to conflicts of law. You also agree any actions at law or in equity
relating to Churchill Mortgage’s terms and conditions may only be filed in
the state or federal courts located in Tennessee.
Emails from Churchill Mortgage may constitute a marketing advertisement or
solicitation under U.S. law if its primary purpose is to market a
commercial product or service. If you do not wish to receive marketing
messages from Churchill Mortgage at a specific Email address, specify your

Churchill Mortgage mobile/text message alerts provide a secure and easy way
to access interest rates and receive promotional and mortgage information
from almost any mobile device or cell phone.
