These Communication Terms of Service ("Communication Terms") govern communications to and from Churchill Mortgage Corporation ("Churchill," "Churchill Mortgage," or the "Company"). By accessing or using the Services, you agree to be bound by these Communication Terms, the Churchill Terms of Use, and our Privacy Policy. If you do not agree, do not use the Services.
Churchill Mortgage is dedicated to revolutionizing the home-buying experience. A significant part of that commitment is prompt and convenient communication with our clients, real estate agents, brokers, vendors, and others. For that reason, we offer various means of communication, including email, text messages, chat, fax, telephone, mail, express mail, voicemail, and mobile push notifications.
To demonstrate our commitment to prompt and convenient communications, we have adopted the following terms and conditions, which are incorporated by reference into all communications sent and received by our Team Members (employees) and systems.
Email is an effective means of communication. However, due to its brief and informal nature, email may not accurately represent the entire or final disposition of a matter or the official business records of the Company. In most instances, communications regarding a particular matter are exchanged through multiple channels, including email, text messages, chat, fax, telephone, voicemail, letters, and in-person discussions.
Accordingly, an email, standing alone, may not accurately reflect the complete communication history or the Company's intent regarding the subject matter referenced therein, nor does it constitute an official business record of the Company. All official matters should be confirmed in signed writings. Additionally, the mere receipt of an email by Churchill Mortgage may not place Churchill Mortgage on notice, whether timely or otherwise, of the matters contained within that email.
Do not use email to communicate time-sensitive instructions or official Company matters, as they may not be received or reviewed by the appropriate Team Member in a timely manner. All emails are processed through various virus and spam filters that may delay or reject delivery. Urgent matters should be communicated directly by telephone and then confirmed in writing via fax or email. The Company reserves the right to block any email source it deems inappropriate.
Unless there is explicit and specific language and disclosure to the contrary, emails from the Company do not contain or constitute an electronic signature, even if the sender's name appears in the email.
Email communications are not intended to be construed as a signed agreement, an interest rate lock, an unconditional loan commitment, an unconditional loan approval, an unconditional qualification, or any unconditional offer or agreement to lend. Such agreements and commitments are generally provided through formal signed writings issued by the Company.
Communications containing nonpublic customer, business, proprietary, or confidential information, including attachments and files, are intended solely for the individual or entity to whom they are addressed. Communications marked "Confidential" contain confidential and/or proprietary information and are provided subject to the condition that such information be maintained in confidence and handled in accordance with applicable privacy laws, including, without limitation, the Gramm-Leach-Bliley Act.
Recipients of Confidential information agree not to disclose or use such information except for the limited and confidential purpose for which it was provided. By accepting and reviewing Confidential information provided by the Company, you agree to indemnify and hold the Company harmless against any claims, losses, liabilities, or expenses, including reasonable attorneys' fees, arising from the unauthorized use or disclosure of Confidential information resulting from your acts or omissions.
Communications exchanged with or involving the Company's Legal Team may contain information protected by the attorney-client privilege and/or attorney work-product doctrine. Such protections shall not be deemed waived because a communication was received in error or improperly forwarded.
If you are not the intended recipient of Confidential or privileged information, or if you received a communication in error, the information contained therein must remain confidential and may not be used or disclosed.
Please notify the sender immediately by telephone or email and permanently delete or destroy the original communication and all copies. Any unauthorized use, disclosure, reproduction, or distribution of Confidential or privileged information is strictly prohibited.
The Company's communication facilities are to be used only for conducting business for the Company. Clients, real estate agents, broker partners, vendors, and others receiving communications from our Team Members may not use our Team Members' email addresses, contact information, or any other person's contact information appearing in Company communications for any purpose other than corresponding with the Company for lawful and legitimate business purposes.
Receipt of a communication does not constitute consent by the Company or its Team Members for the recipient to use such contact information for direct marketing purposes or to transfer data to third parties. Such use is strictly prohibited.
Team Members are prohibited from using Company communication facilities to create, send, or distribute any menacing, defamatory, discriminatory, harassing, offensive, threatening, or otherwise unlawful content, or content that infringes upon the intellectual property or legal rights of others. Such communications are outside the scope of employment and contrary to Company policy. The Company does not accept liability for such communications, and the responsible Team Member may be personally liable for any resulting damages or claims.
The use of Company communication facilities to send menacing, harassing, offensive, or threatening communications to Team Members is prohibited and may be unlawful. Violators may be prosecuted to the fullest extent permitted by law.
The use of Company communication facilities to solicit Team Members to violate employment agreements or otherwise interfere with their employment relationship with the Company is strictly prohibited.

All communications sent to or from Team Members may be forwarded, monitored, reviewed, or accessed by authorized Company personnel other than the designated recipient or sender, with or without notice. This includes communications through email, text messages, chat, fax, telephone, mail, express mail, voicemail, and mobile push notifications
Telephone calls may be monitored or recorded by the Company or its service providers for quality assurance, fraud detection, troubleshooting, compliance, and complaint resolution purposes. If you do not wish to have telephone calls recorded, you should utilize an alternative communication method where available.
By communicating with the Company through these channels, you consent to such monitoring and recording.
You should be aware that standard email is typically transmitted over the internet, which is an open network. Although certain areas of our applications employ technologies designed to secure your information and transmissions, we cannot guarantee that communications sent or received will be secure, error-free, complete, virus-free, or free from loss, delay, interception, or unauthorized access.
Accordingly, the Company recommends that sensitive or personally identifiable information not be transmitted through unsecured email. The Company disclaims liability for communications that are corrupted, lost, destroyed, delayed, incomplete, misdelivered, intercepted, decrypted, or otherwise misappropriated by third parties.
Computer viruses and other malicious code may be transmitted through communications, attachments, files, or embedded links. Although the Company takes reasonable measures to help ensure that communications are free from viruses and other harmful components, recipients remain responsible for implementing appropriate virus detection and protection measures.
The Company is not responsible for any loss or damage arising from the receipt, use, storage, transmission, or opening of communications. For example, content included in forwarded or replied-to messages may have originated from third parties for whom the Company assumes no responsibility.
THE COMPANY DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT ITS COMMUNICATIONS ARE VIRUS-FREE OR ERROR-FREE.
The use of communications to introduce malicious code, interfere with telecommunications systems, email transmissions, chat functionality, or computer networks is prohibited and may violate applicable law.
The Company reserves all rights in its communications and these Communication Terms. No portion of any communication may be reproduced, published, or distributed without the Company's prior written consent.
Official public statements attributable to the Company may only be issued by the Director of Public Relations or an officer of the Company, including the Chairman, Chief Executive Officer, President, or Corporate Counsel.
The Company disclaims responsibility, including responsibility based upon negligence or negligent misstatement, for the accuracy, completeness, or reliability of any information provided through communications. The Company makes no express or implied warranties regarding such information.
The Company disclaims any U.S. federal tax advice contained in communications, including attachments. Any such communication may not be relied upon for purposes of avoiding penalties under the Internal Revenue Code or promoting, marketing, or recommending any transaction or matter addressed therein.
Email messages may constitute advertising or solicitation under applicable U.S. law if their primary purpose is to advertise or promote a commercial product or service.
If you do not wish to receive advertising or promotional email messages from Churchill Mortgage, please follow the unsubscribe instructions contained within the email.
Do not use text messages to communicate time-sensitive instructions or official Company matters. Urgent matters should be communicated directly by telephone and then confirmed in writing with the appropriate person.
The Company reserves the right to block any mobile number it deems inappropriate and to disable text messaging capabilities without notice.
In some instances, responses may be delivered through multiple text messages to accommodate message length limitations. When this occurs, messages may be labeled "1/2," "2/2," "1/3," etc. Due to carrier limitations and network traffic, delivery delays may occur.
Message and data rates may apply to messages sent to or from Churchill Mortgage. Questions regarding your messaging or data plan should be directed to your wireless carrier.
Churchill Mortgage sends rate updates through short codes. These updates are automated informational services and do not constitute an interest rate lock, unconditional loan commitment, unconditional loan approval, unconditional qualification, or any other unconditional offer or agreement to lend.
Churchill Mortgage disclaims responsibility, including responsibility based upon negligence or negligent misstatement, for the accuracy, completeness, or reliability of data or information contained in rate update text messages.
Subscribers may receive SMS or RCS messages regarding mortgage applications, loan information, servicing matters, and rate alerts.
